According to legal expert Truong Van Tuan, Phu Le's history may lead to the application of aggravating circumstances such as 'recidivism' or 'dangerous recidivism' as outlined in Article 52 of the 2015 Penal Code. Recidivism refers to individuals who have been convicted and have not had their criminal record expunged, yet commit a crime intentionally or through serious negligence. Dangerous recidivism applies to those who have been convicted of serious crimes and re-offend, again without having their record cleared.

The law stipulates that a criminal record can be automatically expunged after a certain period, depending on the length of the sentence served. For example, if a person is sentenced to five years or less, their record is cleared after two years. For sentences between five and 15 years, the waiting period is three years, and for sentences exceeding 15 years, including life imprisonment, the period extends to five years.

In Phu Le's case, determining whether he can be subjected to increased penalties hinges on whether his criminal record has been expunged. Additionally, investigators will analyze the specific crimes for which he has previously been convicted to ascertain if they fall under the category of serious or particularly serious offenses.

Furthermore, if it is found that Phu Le has committed crimes two or more times, each constituting a criminal offense, he may also face increased penalties for committing crimes on multiple occasions, as stated in the same legal article.
