The Tuyen Quang Provincial Police have detained a teacher, Nguyen Ha Duy, in connection with suspiciously high scores in the Mathematics exam at Tuyen Quang Specialized High School during the 2026 national high school graduation examination. This action is part of a necessary legal procedure to investigate the circumstances surrounding the exam results.
According to the 2015 Criminal Procedure Code, authorities can detain individuals in urgent situations to prevent potential flight, destruction of evidence, or continuation of criminal activities. Detaining someone does not imply that they have committed a crime; rather, it is a precautionary measure that does not require approval from the People's Procuracy.
After the detention, investigators are required to quickly gather evidence and testimonies, and must decide whether to formally arrest the individual or release them if there is insufficient evidence. The investigation will scrutinize the entire examination process, including the security of exam questions, supervision, grading, and data management.
If any fraudulent activities are uncovered, the consequences will depend on the specific actions involved. Students caught cheating or using unauthorized materials during the exam may face penalties according to the examination regulations, which could include having their exam results annulled. More severe violations, such as leaking exam questions, could lead to criminal charges if sufficient evidence is found.
Lawyer Dang Van Cuong emphasized that if the investigation reveals that officials involved in organizing the exam exploited their positions to alter scores for personal gain, they could face criminal charges under Article 356 of the Penal Code. If score manipulation involved accepting bribes from parents or others, both the recipient and the giver could be prosecuted for bribery-related offenses.
This incident has raised public concerns, reminiscent of previous exam fraud cases in Ha Giang, Son La, and Hoa Binh in 2018, where numerous officials faced criminal charges for tampering with exam results. In the recent exam at Tuyen Quang Specialized High School, 299 out of 328 students achieved scores of 9.0 or higher, a striking statistic compared to similar institutions in Hanoi and other regions.
