Khánh Hòa Implements Regulations to Combat Health Insurance Fraud

On September 17, 2026, the leadership of the Khánh Hòa Social Insurance Agency announced the implementation of activities to promote awareness of Article 215 of the Penal Code concerning health insurance fraud. This initiative is aimed at increasing prevention and control of fraudulent behaviors related to health insurance funds.

The agency has updated regulations from the Law on Medical Examination and Treatment, the Health Insurance Law, and Decree No. 188/2025/ND-CP from the government. Emphasis has been placed on disseminating Article 215 of the Penal Code and relevant guiding regulations.

The dissemination program also addressed Resolution No. 05.2019/NQ-HĐTP from the Supreme People's Court and Document No. 5659/BCA-CSKT from the Ministry of Public Security, which provides guidance on initiating prosecution under Articles 214, 215, and 216 of the Penal Code.

In addition to updating legal regulations, the program included discussions on challenges faced in health insurance medical examination and treatment at healthcare facilities. Attention was drawn to the processes of medical examination, record-keeping, cost settlement, and management of health insurance funds.

Healthcare facilities were urged to enhance their responsibilities and adhere strictly to professional regulations regarding the prescription of technical services, medications, and medical supplies while maintaining accurate medical records. This is to minimize inappropriate prescriptions and avoid unnecessary costs to the health insurance fund.

Healthcare facilities are also required to strengthen self-monitoring to promptly identify and rectify errors, with a firm stance against fraudulent activities, including the forgery of records, prescriptions, or deliberately inappropriate service recommendations.

The program highlighted the importance of monitoring and cooperation between the Social Insurance Agency, the health sector, law enforcement, and healthcare facilities, using practical scenarios for better understanding.

According to the Khánh Hòa Social Insurance Agency, in the first half of 2026, total health insurance revenue reached over 743.4 billion VND, accounting for 48% of the annual estimate. Meanwhile, health insurance expenditures exceeded 657.3 billion VND, also representing 48.4% of the estimate.

Nguyễn Mạnh Tú, Director of the Khánh Hòa Social Insurance Agency, stated that no instances of health insurance fraud have been detected in the area thus far. The dissemination of these regulations is expected to equip relevant units with knowledge for implementing health insurance policies while preventing fraud proactively.
