Proposal to Transfer Investigation Authority in the Military

On September 14, a meeting was held in Hanoi by the Central Military Commission to review a proposal to transfer the investigation authority from the Military Prosecutor's Office to the Security Investigation Agency of the Ministry of Defense, under the Military Security Protection Department. The meeting was chaired by General Phan Van Giang, a member of the Politburo, Deputy Prime Minister, Deputy Secretary of the Central Military Commission, and Minister of Defense. Attendees included members of the Central Military Commission and representatives from various agencies and units within the Ministry of Defense and the General Staff.

During the meeting, a representative from the General Staff presented a report on the proposed transfer of investigation authority. Following the directive from the Ministry of Defense's leadership, the General Staff assigned the Department of Legal Affairs to collaborate with relevant agencies to study and propose the Central Military Commission's Standing Board to consider and provide feedback on this matter.

The report indicated that the transfer would be executed without creating additional organizations or personnel, ensuring a unified and coherent management system for receiving and processing crime reports and allegations.

Based on the report, participants expressed strong agreement with the proposal, analyzing the legal basis, appropriateness, and advantages of its implementation. General Phan Van Giang emphasized the need for the proposal to be thorough and suitable, highlighting several details that required refinement.

He urged military judicial bodies to continue enhancing their professional skills and coordination to effectively address cases in a timely and compliant manner. Additionally, General Giang noted the importance of updating any amendments to the Criminal Investigation Agency Organization Law as they are enacted to ensure practical application in military operations. He also tasked relevant authorities with finalizing documentation and reporting to the competent authorities as required.

Furthermore, the draft law proposed the abolition of the Supreme People's Procuracy's Investigation Agency and the restructuring of the police investigation agencies at the district level.
