The Ministry of Home Affairs has provided detailed guidance on the classification of officials who are transitioning to civil servants. This directive is particularly relevant for individuals who have served as officials for 13 years prior to their transition.

For instance, a case was highlighted involving an individual named Huynh Van Bien, who was appointed as a specialist by the Department of Home Affairs on January 1, 2013. He worked in various public service roles until his transition to a civil servant position in February 2026. As of August 1, 2026, he has held the specialist position for over 13 years and has sought clarification on whether this duration qualifies him for a higher classification as a senior specialist.

In response to inquiries like Bien's, the Ministry of Home Affairs clarified that, according to the Civil Servant Law of 2025 and the Government's Decree No. 170/2025/ND-CP, effective from July 1, 2025, the management and classification of civil servants will be based on job positions rather than previous appointment mechanisms. This means that civil servants will be classified according to the specific job positions they occupy.

Moreover, the Ministry emphasized that the classification of civil servants must adhere to the job description and competency framework associated with their roles. The conditions and standards for civil servants changing job positions are outlined in Decree No. 170/2025/ND-CP, which has been amended by Decree No. 300/2026/ND-CP, effective from August 1, 2026.

The Ministry encourages individuals like Bien to engage with their respective agencies for further guidance and resolution based on these regulations. This systematic approach aims to ensure that the classification process is transparent and aligned with the evolving administrative framework.
