Ministry of Home Affairs Clarifies Staffing Approval for Public Service Units

The Ministry of Home Affairs has provided clarity regarding the approval of staffing numbers in public service units, emphasizing that Decree 106/2020/ND-CP remains in effect. This announcement comes in response to inquiries from public service unit representatives about whether fully autonomous units still require approval for their staffing levels.

In a recent communication, a representative, referred to as Minh Hong, expressed concerns that the decree governing the staffing approval process may no longer be valid. She sought clarification on whether fully autonomous public service units need to seek approval for their workforce numbers, and if so, what the procedures entail.

The Ministry responded that Decree 106/2020/ND-CP is still applicable and that they are in the process of drafting a new decree to replace it. This new regulation will outline the management of staffing levels in public service units, particularly those classified as Group 1.

According to the Ministry, the new regulations will be based on the 2025 Civil Servant Law, which comes into effect on July 1, 2026. Notably, the current legal framework does not mandate the establishment of a management council within these public service units, which has implications for how staffing levels are approved.

This clarification aims to ensure that public service units understand their obligations and the regulatory framework governing their staffing, as the Ministry continues to work on refining these processes.
