As of August 31, 2026, new regulations regarding land registration will come into effect in Vietnam, imposing significant penalties for noncompliance. According to the consolidated document No. 73/2026/VBHN-NĐ-BNNMT issued by the Ministry of Agriculture and Rural Development, individuals who do not register their land as required will be subject to administrative fines.

The fines are structured as follows: a penalty ranging from 1,000,000 VND to 2,000,000 VND will be imposed for failing to register land for the first time, as outlined in Article 132 of the Land Law. More severe penalties, between 2,000,000 VND and 3,000,000 VND, will apply to those who do not register changes in land use according to Article 133 of the same law, with specific exceptions for cases involving investment projects.

Notably, the new Decree 281 includes exceptions for individuals who acquire land use rights to implement investment projects through agreements. In such cases, these individuals will not face the 2,000,000 VND to 3,000,000 VND fines for failing to register changes in land use.

Furthermore, if a violation notice is issued before August 31, 2026, but a penalty decision has not been finalized, the individual will not be penalized. Similarly, if a penalty decision was made between January 31, 2026, and August 31, 2026, but the violator has not complied, the decision will not be enforced.

These regulations highlight the government's efforts to streamline land management and ensure that all land users adhere to the legal requirements for land registration.
