Compensation for Village Secretary Due to Restructuring

A village secretary who also serves as the head of the local front work committee is entitled to compensation following their dismissal due to village restructuring. This compensation is governed by Decree 154/2025/ND-CP, which outlines the rights of individuals affected by such changes.

The individual, who has served in their role for six years, inquired about their entitlements as they approach retirement age. According to legal experts, the individual qualifies for several forms of compensation due to their tenure and proximity to retirement.

Specifically, the decree states that those with over five years of service and less than five years until retirement are eligible for a one-time compensation package. This includes:

  • A one-time payment calculated at 0.8 times their current monthly allowance for each month they retire early, totaling 13 months in this case.
  • A compensation of 1.5 times their monthly allowance for each year of service, which amounts to 6 years in this instance.
  • A separate payment equivalent to three months of their current allowance to assist in job searching.

In addition to these compensations, the individual can choose to preserve their mandatory social insurance contributions or opt for a one-time payout according to social insurance laws, provided they have been contributing during their service.

This restructuring and the accompanying compensation highlight the government's efforts to manage personnel effectively while providing support to those affected by such changes.
