Early Retirement for Kindergarten Teachers Without Pension Deductions

Starting January 1, 2026, the new Education Law in Vietnam will allow kindergarten teachers to retire early at the age of 52, which is five years earlier than the standard retirement age for female teachers. This policy is designed to accommodate the specific needs of educators in early childhood education.

Under the Labor Code of 2019, the retirement age for female kindergarten teachers is set at 57, but the new law provides an option for those who wish to retire earlier. Teachers who are between the ages of 52 and 56 and wish to retire can do so without facing any deductions in their pension benefits.

The Ministry of Home Affairs has issued guidelines regarding the streamlining of staff in kindergartens, clarifying that teachers who meet the age criteria and express a desire to retire will not be subjected to the downsizing policies outlined in Decree 154. This means that those who are eligible for retirement will not be forced to leave their positions unless they choose to do so.

This initiative reflects a broader effort to adapt to the unique challenges faced by kindergarten teachers and to provide them with more options regarding their retirement. The Ministry of Home Affairs has also indicated that local authorities should consider the specific circumstances of teachers who may be eligible for early retirement based on their age and tenure.

The changes aim to enhance the working conditions for educators and ensure that they have the opportunity to retire with dignity and without financial penalties. This policy is part of a series of reforms aimed at improving the education sector in Vietnam and addressing the needs of its workforce.
