500 counts of Muong Thanh Group's Chairman deceiving Vietnamese home buyers

He was accused of cheating apartment customers. According to the second paragraph of Article 198 of the Criminal Law, he was fined 100-500 million Vietnamese dong or imprisoned for 1-5 years. Mr.Than was sued and prohibited from leaving his residence from July 5, 2019.

According to the indictment, he owns 90% of the shares and is the chairman and CEO of Bemes. In 2000, Bemes signed a land lease contract with the Ha Tay District Land Department to build a factory to produce building materials. After changing the plan, in 2008, detailed planning was made for the construction of the CT6 Project in Ha Dong District.

In mid-2010, Bemes repeatedly requested to adjust some plans, but it was not approved by the authorities. The Procuracy accused Mr.Than of still directing the project construction to "seriously violate the construction plan", such as planning mistakes and building on the red line boundary.
With high-rise buildings, he increased the area of the basement, reduced the basement, and increase the attic floor.
Tower B changed from a hotel function to a residential apartment; 495 hotel rooms will be built into one. 582 apartments. He directed the construction of an unapproved CT6C building with 438 apartments.

If the approved low-rise building area is greater than 1. 600 square meters, 15 three-story apartments will be built. However, Mr.Than directed the construction of more than 800 square meters with 38 high-rise apartments. In addition, the whole planning area of the kindergarten construction has been transformed into low-rise apartments.

Since March 2011, he instructed his subordinates to advertise, "providing false information about the legality of the project to sell illegally built apartments". The purpose of this is to make customers trust to sign an apartment sales contract with Bemes and pay the money according to the construction progress. On the contract selling the apartment, Mr.Than signed the contract directly with the client in the name of the general manager. He promised that the project documents have been approved and the design conforms to the construction regulations and will assist the buyer to go through the formalities of the Certificate of land use rights.

According to the indictment, CT6 Project has 1. 620 apartments. After the house was sold to customers, Bemes jointly implemented it and obtained the  Certificate of Land use rights from the Ministry of Environment and Resources of Hanoi, providing them to 916 apartment owners and 18 low-rise ones. The remaining 483 CT6C apartments and 82 other apartments have not yet been registered.

The police cooperated with 488/520 buyers and determined that the amount they bought 488 apartments exceeded 534 billion VND. After deducting the tax of 53 billion VND, it was determined that Mr. Tan had collected more than 481 billion VND. The loss of 488 property buyers who didn't get a Certificate of Land use rights reached 53 billion VND.
