Proposal to Change Social Insurance Contribution Calculation for Pensions

The Ministry of Home Affairs in Vietnam has put forth a proposal to amend the method of calculating social insurance contributions for pension benefits. This move is part of a draft law aimed at revising certain provisions of the Social Insurance Law.

One of the key highlights of the proposal is the adjustment of how partial months of contributions are rounded when determining pension benefits. Specifically, contributions that include partial months will be calculated as follows: contributions of 1 to 3 months will count as a quarter (0.25) year, 4 to 6 months will count as half (0.5) year, 7 to 9 months will count as three-quarters (0.75) year, and contributions of 10 to 11 months will count as a full year (1 year).

The draft law also stipulates that the minimum time required for social insurance contributions to qualify for pension and monthly survivor benefits must be calculated in full years, with each year consisting of 12 months. This clarification is intended to provide a consistent basis for authorities when processing claims and to help workers better understand their entitlements.

In practice, many workers find that their social insurance contribution periods do not align with full years, leading to confusion regarding their benefits. The proposed regulations aim to standardize the treatment of these contributions, ensuring that workers are fairly compensated based on their actual contribution periods.

Additionally, the draft law includes provisions to expand the categories of individuals eligible for social insurance, enhance support for voluntary participants, and refine the roles of the Social Insurance Management Council and the social insurance agency.

As the Ministry seeks public feedback on this draft law, the proposed changes could significantly impact the way pensions are calculated and distributed in Vietnam.
