Vietnamese-American Fugitive Wanted by FBI for $100 Million Fraud

On June 23, FBI officials announced that Emylee Thai, from Texas, has been placed on the agency's Most Wanted list due to allegations of committing healthcare fraud amounting to nearly $100 million. Born on August 27, 1984, Emylee is also known by other names including Tan Kelsey and Le-Thai Kimberly Anhthu.

According to the Houston FBI office, Emylee Thai is accused of executing a fraud scheme involving unnecessary genetic testing, coupled with paying kickbacks to individuals who referred patients or ordered tests. She faces charges of conspiracy to commit healthcare fraud, conspiracy to defraud the U.S. government, and paying kickbacks in a federal healthcare program.

The indictment states that since 2019, Emylee, who owns a laboratory, contracted marketing firms to funnel signed test requisitions from doctors along with DNA samples from beneficiaries of federal insurance programs, typically Medicare patients. In return, these firms received a percentage of the payments that the laboratory received from the federal insurance program after billing for the tests.

Officials noted that these genetic tests, often reimbursed by Medicare for thousands of dollars per beneficiary, were medically unnecessary, and the test results were frequently not utilized in patient treatment. The investigation revealed that Emylee's laboratory submitted payment requests to Medicare totaling approximately $142 million for genetic tests, of which about $95 million was reimbursed.

After her arrest, Emylee was released on bail under certain conditions, including wearing a tracking device. However, on December 8, 2022, the device was removed, and her last known location was recorded at Harry Reid International Airport in Las Vegas. Following unsuccessful attempts to contact and locate her, authorities issued a warrant for her arrest. Investigators believe Emylee fled the U.S. using a private jet under a false identity, and it is suspected that she may currently be in Vietnam.

On July 5, 2023, Emylee was additionally charged with destroying and falsifying records to obstruct a federal investigation. The FBI's Houston office is offering a reward of up to $150,000 for information leading to her capture.
